I received an email from Digeo following up the next chapter in its antitrust lawsuit against Gemstar.Gemstar and Digeo had fallen out over a licensing deal which resulted in Digeo filing an antitrust lawsuit against Gemstar on Sept. 28th. It was then reported that Gemstar reacted with a lawsuit against Digeo over patent infringement of Gemstar's Electronic Program Guide (EPG).
Digeo are alleging that Gemstar's actions had "established a pattern that injures competition and consumers by denying business opportunities for Gemstar's competitors; hindering innovation; and reducing consumer choice, product differentiation and product quality", according to a company spokesperson.
The spokesperson also went on to say that in response to Digeo's antitrust lawsuit Gemstar filed motions seeking dismissal of the lawsuit and for the case to be moved from Seattle to L.A.
Digeo has replied to this stating that "Gemstar has not challenged the legal sufficiency of Digeo's complaint and that the motion should be denied on factual and legal grounds".
The full reply which spans nearly 30 pages can be found at the U.S courts website.
